The short answer
On post-completion OPT you can be unemployed for up to 90 days total. If you get the 24-month STEM OPT extension, you get 60 more days, for 150 total across your whole OPT period. The 150 is an aggregate limit, not a fresh start: days you used on regular OPT count toward it.
How the math works
| Situation | Unemployment allowed | Example |
|---|---|---|
| Post-completion OPT only | 90 days | Used 40 days, 50 remain |
| OPT plus STEM OPT | 150 days total | Used 40 on OPT, 110 remain on STEM |
| Cap-gap period | No extra days | Counts toward your existing 90 or 150 |
The clock starts on the start date printed on your EAD card, not the day you received it.
What counts as employment
- On regular OPT: work must be related to your degree and total more than 20 hours per week. Several part-time jobs can add up.
- On STEM OPT: each job must be at least 20 hours per week, with an E-Verify employer, under a signed Form I-983 training plan.
- Paid or unpaid: unpaid work related to your field can count on regular OPT if it follows labor laws. STEM OPT requires a paid, bona fide employee relationship.
Common mistakes that burn days
- Traveling abroad while unemployed. Time outside the US during OPT counts as unemployment.
- Forgetting to report. If you don't report a job in the SEVP Portal, SEVIS may count you as unemployed.
- Assuming cap-gap resets the clock. It doesn't.
- Waiting too long between jobs. A short gap is fine; repeated gaps add up fast.
What happens if you go over
Exceeding the limit is a violation of F-1 status. It can lead to SEVIS termination, and going over 90 days on regular OPT also makes you ineligible for the STEM extension. If you are getting close, talk to your DSO immediately.
Track your days
SEVIS keeps an official count, but you should keep your own. Our free OPT Unemployment Day Tracker lets you enter your EAD start date and job gaps and shows your remaining days. It runs in your browser and saves nothing.

On October 8, 2026, the Department of Homeland Security proposed new fees that schools would pay to recommend F-1 students for Optional Practical Training. The headline number is $70,000 for an initial OPT recommendation and $30,000 for each later one, including the STEM OPT extension.
Is the $100,000 H-1B Fee Still in Effect? The November 2026 Status
No. The $100,000 H-1B fee is not being collected as of November 2026. Courts have blocked it, and a second judge struck down the September 2026 version that tried to extend it. But there is a separate, newer proposal for a $103,265 fee, and that one would matter far more to international students.

The H-1B lottery is no longer purely random. Since February 27, 2026, USCIS uses a weighted selection that gives more chances to jobs paid at higher wage levels. FY2027 was the first season under this system, and the next registration, for FY2028, is expected around March 2027.
