The short answer
Regular post-completion OPT is flexible: contract work, temp agency jobs and even self-employment can qualify if the work is related to your degree. STEM OPT is strict: you need a W-2 job with an E-Verify employer that directly trains and supervises you. C2C and 1099 arrangements generally do not work on STEM OPT.
First, the terms
- W2: you are the company's employee. Taxes are withheld and you get a W-2 form.
- 1099: you are an independent contractor paid without withholding.
- C2C (corp-to-corp): the client pays a company, often one you own, rather than paying you directly.
What regular OPT allows
| Work type | Regular OPT | STEM OPT |
|---|---|---|
| W-2 job with a direct employer | Yes | Yes, if E-Verify and I-983 |
| Staffing agency W-2, client site | Yes | Only if the agency trains and supervises you |
| 1099 contract work | Possible if degree-related | No |
| Self-employment or your own corp (C2C) | Possible if degree-related and documented | No |
| Unpaid work in your field | Possible if it follows labor laws | No |
On regular OPT you still need more than 20 hours a week of degree-related work in total, and you must report every employer and your job details to your DSO or the SEVP Portal.
Why STEM OPT is different
The STEM extension is a training program. The employer that signs your Form I-983 must be the same employer that pays you, trains you and evaluates you. Self-employment, sole proprietorships and independent contractor setups cannot meet that requirement.
This is why many students who worked C2C on regular OPT need to switch to a W-2 role before applying for STEM OPT.
Practical tips
- If you plan to use STEM OPT, start on W-2 early. It avoids a forced job change later.
- Keep proof of every job: offer letters, job descriptions showing the link to your degree, and pay records.
- Be cautious with layered vendors. The more layers between you and the end client, the harder it is to show who actually supervises you.
- Ask your DSO before signing anything other than a standard W-2 offer.
Frequently asked questions
Is C2C illegal on OPT? Not automatically. Regular OPT permits several work arrangements if the work is related to your field and properly reported. The details matter, so check with your DSO.
Can I do C2C on STEM OPT? Generally no. STEM OPT requires a bona fide employer-employee relationship, which C2C and 1099 setups don't provide.
Can a staffing firm hire me on W-2 for STEM OPT? Yes, if it is an E-Verify employer that trains and supervises you and signs your I-983.

Is the $100,000 H-1B Fee Still in Effect? The November 2026 Status
No. The $100,000 H-1B fee is not being collected as of November 2026. Courts have blocked it, and a second judge struck down the September 2026 version that tried to extend it. But there is a separate, newer proposal for a $103,265 fee, and that one would matter far more to international students.
